Unfilled State Delegate Seat Election

This year the Modena precinct did not hold a caucus meeting. In meeting as an executive committee we did not like having a delegate seat to the state convention going unfilled so we looked to our County Constitution and By-laws on how to fill the seat. While by-laws section 9.f.2 addresses how to fill a vacated seat no where in our constitution or by-laws does it address how to elect a seat that was never filled by a precinct that would not hold a caucus meeting. So we then looked to the State Republican Construction for and answer and found it in article 12 sec 1.d which reads as follows, “If any precinct fails to elect sufficient delegates to the county convention or state convention, the County Central Committee may designate delegates to the county convention from qualified members residing in the precinct, and the state delegate positions may be filled from qualified members by the county convention. These state delegates shall reside in the same congressional, Utah House, and Utah Senate districts as the precinct.”

With that back ground the executive committee has decided to add this state seat as a position to be elected at our county nominating convention on April 7th, 2012. In an effort to minimize the effect of this election on the length of the convention the executive committee will accept nominations for this seat from any duly elected county delegate for this convention. Each county delegate may only nominate one candidate. Once a nomination has been submitted to the Executive Committee by a county delegate that delegate can not withdraw his/her nomination. All nominations must be submitted in writing to a member of the county executive committee by midnight(11:59 PM) March 31st, 2012. The Executive committee will then tally the nominations and put the top three candidates on the ballot for county convention. In the result of a tie the decision will be made by a coin toss.
